1.1. RVSM airspace comprises all the flight levels BTN the FL290 and FL410 inclusive within the Amazônica Brasília Curitiba and Recife FIR as well as within the Atlântico FIR.

RMK: About the RVSM on the EUR/SAM corridor consult the chapter ENR 3.3 of AIP-BRASIL.

1.2. Except as provided in the route charts for the levels on some ATS routes, the Cruise Levels to be used in RVSM Airspace shall be as listed in the following table:

1.3. The minimum vertical separation of 1000 ft will be assigned by the ATC unit between RVSM certified aircraft. This certification will be provided by the Registration State or the Operator State, as appropriate, to aircraft capable of complying with the Minimum Aviation System Performance Standards (MASPS) on the altitude maintenance (or equivalent).

1.4. The Brazilian civil aircraft operator should contact the National Civil Aviation Agency (ANAC) to obtain the RVSM authorization. The foreign aircraft operator should consult the pertinent State authority.

1.5. RVSM non-approved aircraft can also fly in RVSM airspace, if observed the restrictions in this regulation.

1.6. The minimum vertical separation of 2000 feet will be applied between RVSM non-approved aircraft and between those and other aircraft.

1.7. Independent of the aircraft RVSM approval status, flight levels described in 1.2 can be used.

1.8.1. Only the operators of RVSM approved aircraft shall indicate their RVSM approval status by entering the letter W in item 10 of the Flight Plan form, independently of the requested flight level.

1.8.2. In the specific case of Repetitive Flight Plan, those operators should indicate their RVSM approval status by entering the letter W in the item “Q” of RPL, independently of the requested flight level, in the following way: “EQPT/W.”

1.9.1. State aircraft flights, first delivery flights, maintenance or humanitarian flights, performing domestic or international flights, will be authorized to operate within the RVSM airspace even if the used aircraft are not approved RVSM.

1.9.2. For the purpose of this regulation it is considered:

a) State aircraft – those used for military, customs or police services (according to the Convention of International Civil Aviation;

b) Maintenance flight – the aircraft coming back to the maintenance base to have its altimetric system, repaired in order to reacquire the capacity to fly in the RVSM airspace or, if the flight happens after the aircraft has had the maintenance, done, in order to check if it is ready to come back to the RVSM operation;

c) First delivery flight – initial delivery of an aircraft after being sold, to its new operator;

d) Humanitarian flights– those aircraft transporting or destined to transport sick or wounded persons in serious conditions, that require urgent medical assistance, or vital organ destined to transplant in human body.
 

1.9.3. Those operators, in case they intend to enter the RVSM airspace, shall enter the STS/NONRVSM text in the item 18 of the Flight Plan form, and the intended flight level in the item 15.

1.10.1. The pilot in command of RVSM approved aircraft shall make sure that, at least the following equipment for flight in the RVSM airspace are normally operating:

a) Two independent primary altimetric systems;

b) SSR transponder mode C or S;

c) An altitude alert system;

d) An automatic altitude-keeping device.

1.10.2. If any equipment listed above in 1.11.1 is not operating appropriately, the pilot shall notify the ATC unit before entering the RVSM airspace, using the phraseology: “NEGATIVE RVSM"

1.10.3. The pilot in command of civil aircraft shall also observe the rules pertinent to aircraft operation in RVSM airspace contained in the Brazilian Regulations of Aeronautical Homologation (RBHA) or Brazilian Rules of Civil Aviation(RBAC) issued by ANAC.

1.10.4. The Air Traffic Control unit, on the occasion of the Air Traffic Control clearances related to the RVSM airspace flight, should consider that the rules mentioned in 1.11 have been observe.

1.11.1. During changes of flight level, an aircraft shall not overshoot the cleared flight level by more than 150 FT (45m).

1.11.2. In order to avoid that unnecessary Resolution Advice (RA) be issued, aircraft equipped with TCAS II should possess that equipment version that meets the performance requirements referring to ACAS II (Airborne Collision Avoidance System), prescribed in the Annex 10 to the International Civil Aviation Convention.

1.11.3. If one of the primary altimetric systems fail but the remaining altimetric system is normally functioning, the pilot
in command should:

a) Couple the system to the altitude-keeping device (AKD);

b) Increase the surveillance of the altitude keeping; and

c) Notify the ATC unit of the system failure, using the following phraseology: “FOR INFORMATION, OPERATING ON ONE ALTIMETRIC SYSTEM ONLY”.

1.11.4. If all primary altimetric systems fail, or are considered unreliable, the pilot should:

a) Maintain the flight level indicated on the standby altimeter (if the aircraft has one) at the time of failure or when the systems are considered unreliable;

b) Alert nearby aircraft, by turning on all external lights;

c) Notify the Air Traffic Control unit of the system failure, using the phraseology “NEGATIVE RVSM” , and informing the intended actions; and

d) If no contact is established with the Air Traffic Control, broadcast failure advice, position, flight level and intentions on 121.50MHz.

1.11.5. If the primary altimetric systems diverge by more than 200 feet, the pilot should try to determine the defective altimetric system through the established procedures and/or comparing the primary altimetric systems to the standby altimeter, coupling the functioning altimetric system to the altitude-keeping device and proceed as in paragraph 1.12..3

1.11.6. If the SSR Transponder Mode C or S fails, the pilot should notify the Air Traffic Control unit of the mentioned failure, using the phraseology “NEGATIVE RVSM.”

1.11.7. If the altitude alert system fails, the pilot should notify the Air Traffic Control unit of the mentioned failure, using the phraseology “NEGATIVE RVSM.”

1.11.8. If the automatic altitude-keeping device fails, the pilot should initiate the following actions:

a) Maintain the cleared flight level;

b) Evaluate the aircraft capability to maintain the cleared flight level through manual control;

c) Assess the situation regarding possible conflicting traffic;

d) Alert nearby aircraft by turning on all external lights;

e) Notify the Air Traffic Control of the system failure using the phraseology “NEGATIVE RVSM” and inform the intended actions;

f) If no contact with the Air Traffic Control is established, broadcast failure warning, position, flight level and intentions on 121.5MHz

1.12. The air traffic control unit should interrupt the RVSM separation in a certain airspace, when pilots inform the existence of severe turbulence in that airspace.

1.12.1. When the RVSM procedures are suspended, the following cruising levels table will be applied within the RVSM airspace:

2.1.1. Direct Routing (DCT) provides airspace users with more planning options, at the FIR level, so that the route's nominal distance decreases compared to the fixed ATS route network.

Note: Where DCT airspace concept won´t be used, fixed ATS routes will be aplied, observing the Route Playbook established at the DECEA AISWEB Portal: Routes Playbook (https://aisweb.decea.mil.br/?i=espaco-aereo&p=playbook); When it´s not possible to use the fixed route network or Route Playbook, the flight plan with DCT path can be presented, witch will be evaluated by AIS and ATC facilities involveds.
